WASHINGTON, D.C. — On April 20, President Donald J. Trump issued a Presidential Determination pursuant to Section 303 of the Defense Production Act (DPA) of 1950, as amended, to support and expand U.S. coal supply chains and baseload power generation capacity. This directive authorizes the Secretary of Energy to take immediate action—including government purchases and financial support—to ensure the resilience of the nation’s electric grid against growing national security threats.
Strengthening National Defense through Energy Reliability
The determination follows Executive Order 14156, which declared a National Energy Emergency in January 2025. The President found that current “inadequate and intermittent” energy supplies leave the United States vulnerable to hostile foreign actors and pose an imminent threat to national security and economic prosperity.
Ensuring “… reliable coal supply chains and baseload power generation capacity is essential to United States national defense,” the President stated in the memorandum. “Coal mining and logistics, terminals, stockpile, and power generation facilities provide indispensable resilience to our power grids that cannot be replaced. Without sufficient coal-fired baseload power, the United States will lack the stable electricity required to support defense installations, industrial expansion, and the high-energy demands of emerging technologies, such as artificial intelligence.”
Key Provisions of the Determination
Under the authorities of Section 303, the Secretary of Energy is directed to prioritize the following critical areas:
- Coal Supply Chain Infrastructure: Supporting coal mining, rail and barge logistics, and both export and domestic terminals.
- Baseload Plant Longevity: Enabling life-extension work, on-site stockpiles, and essential reliability updates for generating units.
- Waiver of Procedural Barriers: To accelerate implementation, the President exercised authority under section 303(a)(7) to waive standard requirements, allowing for more expedient deployment of federal funds and contracts.
Industry and National Security Impact
The National Mining Association (NMA) lauded the move, stating that preserving coal-fired power is a “key part of a truly comprehensive national security strategy”. While analysts noted that the move aims to tackle rising fuel prices linked to geopolitical tensions, they also cautioned that the full impact will depend on available funding and potential legal challenges.
This action is part of a broader suite of DPA determinations aimed at revitalizing domestic energy production, including natural gas, petroleum, and electric grid infrastructure.
